\u6b61\u8fce\u6536\u807d\u300c\u9577\u8005\u6cd5\u7db2\u667a\u591a\u8072\u300d\u3002\u300c\u9577\u8005\u4e09\u5bf6\u300d\uff0c\u5373\u6301\u4e45\u6388\u6b0a\u66f8\u3001\u907a\u56d1\u548c\u9810\u8a2d\u91ab\u7642\u6307\u793a\u4e4b\u4e2d\uff0c\u76f8\u4fe1\u5927\u5bb6\u6700\u5e38\u807d\u5230\u7684\u5c31\u662f\u907a\u56d1\uff0c\u4ea6\u5373\u662f\u300c\u5e73\u5b89\u7d19\u300d\u3002\u9019\u4e00\u7bc0\u6211\u5011\u6703\u70ba\u5927\u5bb6\u8aaa\u4e00\u4e0b\u907a\u7522\u627f\u8fa6\u548c\u907a\u56d1\u3002<\/p>\n

\u4e00\u822c\u4f86\u8aaa\uff0c\u60a8\u53ef\u4ee5\u6c7a\u5b9a\u81ea\u5df1\u7684\u8ca1\u7522\u600e\u6a23\u5206\u914d\u548c\u7559\u7d66\u8ab0\uff0c\u597d\u50cf\u662f\u7559\u7d66\u89aa\u4eba\u3001\u670b\u53cb\u6216\u6148\u5584\u6a5f\u69cb\u7b49\uff0c\u53ea\u8981\u5728\u5e73\u5b89\u7d19\u4e0a\u5beb\u6e05\u695a\u5c31\u53ef\u4ee5\u4e86\u3002\u5e73\u5b89\u7d19\u53ef\u4ee5\u8aaa\u662f\u60a8\u8ddf\u5bb6\u4eba\u50b3\u9054\u7684\u6700\u5f8c\u8a0a\u606f\uff0c\u9019\u6a23\u91cd\u8981\uff0c\u8a02\u7acb\u4e4b\u524d\uff0c\u6700\u597d\u9084\u662f\u5148\u8aee\u8a62\u5f8b\u5e2b\u3002<\/p>\n

\u4efb\u4f55\u5e74\u6eff18\u6b72\u800c\u53c8\u7cbe\u795e\u5065\u5168\u7684\u4eba\uff0c\u90fd\u53ef\u4ee5\u8a02\u7acb\u5e73\u5b89\u7d19\u3002\u5e73\u5b89\u7d19\u5fc5\u9808\u8981\u767d\u7d19\u9ed1\u5b57\u5beb\u4e0b\u4f86\uff0c\u60a8\u8981\u5728\u5169\u540d\u898b\u8b49\u4eba\u540c\u6642\u5728\u5834\u4e4b\u4e0b\uff0c\u5728\u4ed6\u5011\u9762\u524d\uff0c\u5728\u5e73\u5b89\u7d19\u4e0a\u7c3d\u540d\u3002\u5169\u540d\u898b\u8b49\u4eba\u4e4b\u5f8c\u4ea6\u5fc5\u9808\u5728\u60a8\u9762\u524d\uff0c\u5728\u5e73\u5b89\u7d19\u4e0a\u7c3d\u540d\u3002\u5e73\u5b89\u7d19\u6700\u597d\u5148\u5beb\u4e0a\u65e5\u671f\uff0c\u7136\u5f8c\u518d\u7c3d\u540d\u3002\u8981\u7559\u610f\u4e86\uff0c\u5169\u4f4d\u898b\u8b49\u4eba\uff0c\u4e0d\u53ef\u4ee5\u662f\u60a8\u7684\u907a\u7522\u53d7\u76ca\u4eba\u6216\u4ed6\u5011\u7684\u914d\u5076\uff0c\u5426\u5247\u4ed6\u5011\u5c07\u4f86\u4fbf\u62ff\u4e0d\u5230\u60a8\u7684\u907a\u7522\u3002<\/p>\n

\u60a8\u53ef\u4ee5\u5728\u5e73\u5b89\u7d19\u4e0a\uff0c\u6307\u5b9a\u4e00\u81f3\u56db\u500b\u53ef\u9760\u7684\u4eba\uff0c\u64d4\u4efb\u60a8\u7684\u907a\u7522\u4ee3\u7406\u4eba\uff0c\u4ed6\u5011\u6703\u4ee3\u7406\u60a8\u7684\u8ca1\u7522\uff0c\u76f4\u81f3\u7ba1\u7406\u53ca\u5206\u767c\u5de5\u4f5c\u5b8c\u6210\u70ba\u6b62\u3002\u907a\u7522\u4ee3\u7406\u4eba\u53ef\u4ee5\u540c\u6642\u662f\u60a8\u7684\u907a\u7522\u53d7\u76ca\u4eba\uff0c\u4f46\u8a18\u5f97\u8981\u5beb\u6e05\u695a\u3002<\/p>\n

\u5982\u679c\u8a02\u7acb\u5e73\u5b89\u7d19\u4e4b\u5f8c\u60f3\u66f4\u6539\uff0c\u53ef\u4ee5\u7528\u540c\u6a23\u7684\u65b9\u6cd5\uff0c\u518d\u8a02\u7acb\u4e00\u4efd\u65b0\u7684\u5e73\u5b89\u7d19\uff0c\u8a18\u5f97\u5beb\u660e\u539f\u672c\u90a3\u4e00\u4efd\u5df2\u7d93\u53d6\u6d88\u4e86\u3002<\/p>\n

\u5728\u8003\u616e\u600e\u6a23\u5beb\u5e73\u5b89\u7d19\u4e4b\u524d\uff0c\u6709\u67d0\u4e9b\u4e8b\u60a8\u53ef\u80fd\u8981\u5148\u60f3\u6e05\u695a\u3002\u8209\u4f8b\u8aaa\uff0c\u5982\u679c\u907a\u7522\u53d7\u76ca\u4eba\u9084\u672a\u592018 \u6b72\uff0c\u60a8\u53ef\u4ee5\u5728\u5e73\u5b89\u7d19\u5beb\u660e\uff0c\u7b49\u4ed6\u5230\u4e86\u67d0\u500b\u5e74\u7d00\uff0c\u624d\u53ef\u4ee5\u7e7c\u627f\u907a\u7522\uff0c\u671f\u9593\u907a\u7522\u4ee3\u7406\u4eba\u6703\u4ee3\u70ba\u6258\u7ba1\u9019\u7b46\u907a\u7522\u3002\u5982\u679c\u907a\u7522\u53d7\u76ca\u4eba\u56e0\u70ba\u6b98\u75be\u4e0d\u80fd\u5920\u7167\u9867\u81ea\u5df1\uff0c\u60a8\u4e5f\u53ef\u4ee5\u5728\u5e73\u5b89\u7d19\u4e0a\u59d4\u4efb\u4fe1\u8a17\u4eba\uff0c\u4ee3\u70ba\u7ba1\u7406\u4ed6\u7e7c\u627f\u5230\u7684\u90a3\u4e00\u7b46\u8ca1\u7522\u3002\u9664\u4e86\u5982\u4f55\u5206\u914d\u907a\u7522\u4e4b\u5916\uff0c\u5e73\u5b89\u7d19\u4ea6\u53ef\u4ee5\u4ea4\u4ee3\u60a8\u60f3\u5982\u4f55\u5b89\u6392\u8eab\u5f8c\u4e8b\u3002<\/p>\n

\u82e5\u60a8\u5e74\u4e8b\u5df2\u9ad8\u3001\u66fe\u7d93\u4e2d\u98a8\u3001\u60a3\u6709\u8001\u4eba\u7661\u5446\u75c7\u3001\u6216\u60a3\u6709\u5176\u4ed6\u53ef\u80fd\u5f71\u97ff\u60a8\u7cbe\u795e\u72c0\u6cc1\u7684\u91cd\u75c5\uff0c\u8a18\u5f97\u8981\u5728\u8a02\u7acb\u5e73\u5b89\u7d19\u4e4b\u524d\uff0c\u5148\u627e\u91ab\u751f\u6aa2\u67e5\u548c\u7d00\u9304\u60a8\u7684\u7cbe\u795e\u72c0\u6cc1\uff0c\u4ee5\u514d\u65e5\u5f8c\u5bb6\u4eba\u8aaa\u60a8\u8a02\u7acb\u5e73\u5b89\u7d19\u6642\u7cbe\u795e\u932f\u4e82\uff0c\u8981\u6c42\u6cd5\u5ead\u63a8\u7ffb\u60a8\u7684\u5e73\u5b89\u7d19\u3002<\/p>\n

\u8a02\u597d\u5e73\u5b89\u7d19\u4ee5\u5f8c\uff0c\u8a18\u5f97\u8981\u653e\u597d\uff0c\u9084\u8981\u544a\u8a34\u907a\u7522\u4ee3\u7406\u4eba\u5e73\u5b89\u7d19\u653e\u5728\u54ea\u88e1\u3002<\/p>\n

\u5982\u679c\u6c92\u6709\u8a02\u7acb\u5e73\u5b89\u7d19\u53c8\u5982\u4f55\u5462\uff1f\u6839\u64da\u6cd5\u4f8b\uff0c\u60a8\u7684\u89aa\u4eba\u53ef\u4ee5\u6709\u4e0d\u540c\u512a\u5148\u6b21\u5e8f\uff0c\u7533\u8acb\u6210\u70ba\u60a8\u7684\u907a\u7522\u4ee3\u7406\u4eba\uff0c\u4ee3\u7406\u60a8\u7684\u8ca1\u7522\uff0c\u76f4\u81f3\u7ba1\u7406\u53ca\u5206\u767c\u5de5\u4f5c\u5b8c\u6210\u70ba\u6b62\u3002<\/p>\n

\u5728\u6263\u9664\u60a8\u7684\u50b5\u52d9\u3001\u7a05\u9805\u3001\u846c\u79ae\u53ca\u6cd5\u5f8b\u7b49\u8cbb\u7528\u4ee5\u5f8c\uff0c\u60a8\u7684\u8ca1\u7522\u6703\u6839\u64da\u6cd5\u5f8b\uff0c\u6309\u6b21\u5e8f\u5206\u914d\u3002\u5728\u4e00\u822c\u60c5\u6cc1\u4e4b\u4e0b\uff0c\u5728\u751f\u7684\u914d\u5076\u548c\u5b50\u5973\uff0c\u6703\u512a\u5148\u5206\u5f97\u60a8\u7684\u8ca1\u7522\u3002\u5982\u679c\u60a8\u53ea\u7559\u4e0b\u4e08\u592b\u6216\u59bb\u5b50\u3001\u6c92\u6709\u5b50\u5b6b\uff1b\u6216\u662f\u6709\u5b50\u5b6b\u5728\u751f\uff0c\u4f46\u914d\u5076\u5df2\u7d93\u904e\u8eab\uff1b\u751a\u81f3\u662f\u6709\u79c1\u751f\u5b50\u5973\uff0c\u53c8\u6216\u662f\u57281971\u5e7410\u67087\u65e5\u4e4b\u524d\u7d0d\u4e86\u59be\u4f8d\uff0c\u4e0d\u540c\u7684\u60c5\u6cc1\uff0c\u5206\u914d\u8ca1\u7522\u7684\u65b9\u6cd5\u90fd\u4e0d\u540c\u3002\u5982\u679c\u60f3\u77e5\u9053\u66f4\u591a\uff0c\u53ef\u4ee5\u53c3\u8003\u9577\u8005\u793e\u5340\u6cd5\u7db2\u6587\u5b57\u7248\u3002\u9019\u4e00\u7bc0\u5c31\u8aaa\u5230\u9019\u88e1\uff0c\u8b1d\u8b1d\u5927\u5bb6\u6536\u807d\u3002[\/et_pb_blurb][et_pb_code admin_label=”Print” _builder_version=”4.17.3″ _module_preset=”default” global_colors_info=”{}”]<\/p>\n

Although this is not an \u00a0exhaustive list, you may take the following points as a basic reference:<\/p>\n

Funeral Arrangements<\/h2>\n

You may indicate in your will your preferred form of funeral and burial arrangements, e.g. land burial or cremation, Taoist, Buddhist or Christian ceremonies etc., but it should be noted that these are only expressions of wishes and have no legal effect. Therefore, you may choose to prepare a document to record the wishes and details of your funeral and burial arrangements in addition to the will, and then put this document near the will so that your relatives and friends can find it easily in the future. You can also update this document on funeral and burial arrangements from time to time instead of revising your will every time.<\/p>\n

Personal items<\/h2>\n

If you have not stated in your will who should take your personal items such as furniture, clothing, accessories, vehicles or other items of memorable value, those items would be considered as part of the your estate and will be sold and then distributed in the form of money.<\/p>\n

Too young a beneficiary<\/h2>\n

If a beneficiary of your will has not reached the age of 18 by the time you pass away, your executor would normally put the assets that you leave behind for that beneficiary on trust until he or she reaches 18. If you are worried that it is not good for the growth of your child or grandchild to succeed your assets at too young an age, you may specify in your will that your full assets can only be received at an older age (e.g. 25 or 30) and that before then your child or grandchild can only receive small sums for their daily and educational expenses.<\/p>\n

Disabled beneficiary<\/h2>\n

If a beneficiary of your will is unable to look after him\/herself due to disability, you may appoint a trustee to manage the assets that you leave behind for him\/her.<\/p>\n

Your beneficiary unfortunately passes away before you do<\/h2>\n

According to\u00a0section 23 of the Wills Ordinance (Cap. 30)<\/a>, if a descendent of yours is a beneficiary of your will and he\/she passes away before you do, leaving behind descendent(s) of his\/her own, then generally his\/her descendent(s) will take over the assets that you originally leave behind for your fallen descendent. You can also specify the backup arrangements when you make the will, for example, which alternate beneficiary (or beneficiaries) you would like to leave the estate intended for your daughter to in the event that your daughter passes away before you do.<\/p>\n

Charitable Donation<\/h2>\n

In addition to distributing your estate to family and friends, many people choose to make a donation to charitable organisations to perpetuate their personal beliefs and values while leaving a little warmth in the world. Instead of making a donation now, legacy giving means designating charitable organisations as beneficiaries in your will and distributing a portion of your estate to them.<\/p>\n

In fact, you can make a legacy donation to any organisation you support, whether it is a registered charitable organisation or a business, but it must be a \u201clegal entity\u201d that can inherit the estate. For example, if you wish to make a donation to a Buddhist temple in your community and it is not itself a registered company, a registered business, a registered society, or a corporation established through an ordinance, but is operated by a Buddhist organisation (which is a limited company), you need to specify in your will that the estate is to be given to that Buddhist organisation for the purpose of operating the Buddhist temple. In general, the will should include information about the legal entity of the charitable organisation, such as its business registration number. It is not necessary to state the licence number of the charity exempted from tax under section 88 of the Inland Revenue Ordinance.<\/p>\n

If you wish to donate real estate property to a charitable organisation after your death, the following situations would be appropriate for such a charitable donation:<\/p>\n

    \n
  1. you are the sole owner of the property; and<\/li>\n
  2. you specify in the will that the executor will sell the property and then donate all or part of the proceeds.<\/li>\n<\/ol>\n

    Medical Certification<\/h2>\n

    If you are rather old, suffering from stroke, Alzheimer\u2019s disease or any other severe diseases that may affect your mental condition, you should invite your attending doctor, or even a neurologist or a psychiatrist, to examine and record your mental condition when you make your will (preferably on the same day). This is to prevent your family from attempting to use poor mental condition as a reason for challenging your will in court.<\/p>\n

    Estate Duty<\/h2>\n

    Estate Duty was abolished on 11st February, 2006. \u00a0Under the current laws of Hong Kong, there is no need to consider the question of estate duty for those of you who survive beyond that date.<\/p>\n

    Can I not leave any asset to my wife or my infant children?<\/h2>\n

    Generally speaking, you have the freedom to decide how to distribute your estate. Differently put, you may by your will decide to whom you would and whom you would not leave your assets. As said before, you may even not leave a dime to your families but leave it all to charities or, perhaps, your caretaker or neighbours who have taken care of you. However, persons who have been dependent on your financial support for a living or to whom you owe the moral obligation of financial support, such as your wife, infant children, aged parents, or even a mistress, may apply to the court for an order that certain parts of your estate shall be given to them to maintain their living.
    (    Section 3<\/a>,\u00a04<\/a>\u00a0and\u00a05 of the Inheritance (Provision for family and dependents) Ordinance (Cap. 481)<\/a>)<\/p>\n

    Is your will going to be cancelled automatically if you get married or divorced after you make it?<\/h2>\n

    If you get married after making it, your will would generally be cancelled automatically. If at the time of making the will, you are expecting to marry someone, you should make it clear in the will that it will continue to be valid even if you marry that person (who must be identified in the will) in the future. In contrast, if you get divorced after making it, your will would generally not be cancelled automatically. But if, in your will, you have appointed your ex-husband or ex-wife to be your executor, or if you have left behind any assets to him\/her, those parts of your will would be cancelled automatically (section 14<\/a>\u00a0and\u00a015 of the Wills Ordinance (Cap. 30)<\/a>.<\/p>\n

    Keeping your will properly<\/h2>\n

    You should keep the original copy of your will properly after you make it or else your wishes may not be implemented if your will is lost or damaged subsequently. You may choose to keep your will at home or other private premises. But you should make sure that the will would not get lost easily and that your executor knows how to locate it. As there might be many years between the time you make your will and your passing away, it is quite possible that you might lose the will when you move or renovate your apartment, or you might forget about it due to a decline in your memory as you get older. In the event that the original copy of the will is lost or damaged, a new one should be made as soon as possible to replace the old one. If the executor is a reliable person who is younger than you, you may consider handing over the original copy of the will to the executor for safekeeping.<\/p>\n

    In the past, some solicitors firms were willing to keep the original copies of the wills for their clients, but nowadays, due to practical considerations, very few solicitors firms are willing to provide this service. If the deceased has made a will through a solicitors firm and deposited the original copy of the will with that firm, then the executor may try to contact that firm to obtain the original copy of the will. If he or she has no idea through which firm you have made your will, he or she can engage a solicitors firm to publish a will search notice for a fee in the electronic newsletter regularly issued by the Law Society of Hong Kong to the profession (i.e. all registered members of the Law Society in Hong Kong<\/a>). If the solicitors firm holding the original copy of the will sees the notice, it can contact your firm directly to make arrangements.<\/p>\n

    On the other hand, keeping wills in bank safe deposit boxes was a common practice in the past, but this practice has become less popular in recent years. Since your executor himself has no right to open up your safety deposit box, he has to be authorized by the Home Affairs Department to open your bank safe deposit box to obtain your will, which can be a very complicated and lengthy process and is not legally necessary. (section 60D of the Probate and Administration Ordinance (Cap. 10)<\/a>)<\/p>\n
