href=\"https:\/\/seniorclic.hk\/wp-content\/uploads\/employment-1.mp3\">https:\/\/seniorclic.hk\/wp-content\/uploads\/employment-1.mp3<\/a><\/audio>\n<p>\u6b61\u8fce\u6536\u807d\u300c\u9577\u8005\u6cd5\u7db2\u667a\u591a\u8072\u300d\u3002\u7121\u8ad6\u60a8\u662f\u6b63\u5728\u6253\u5de5\u9084\u662f\u8001\u95c6\uff0c\u90fd\u61c9\u8a72\u8981\u8a8d\u8b58\u8207\u50f1\u50ad\u6709\u95dc\u7684\u6cd5\u4f8b\u3002\u6211\u5011\u6703\u4e00\u9023\u5e7e\u7bc0\u70ba\u5927\u5bb6\u4ecb\u7d39\u4e00\u4e0b\u3002\u9019\u4e00\u7bc0\u5c31\u5148\u8aaa\u4e00\u4e0b\u50f1\u50ad\u5408\u7d04\u548c\u5de5\u8cc7\u3002<\/p>\n<p>\u300c\u50f1\u50ad\u5408\u7d04\u300d\uff0c\u5373\u50f1\u4e3b\u8207\u50f1\u54e1\u4e4b\u9593\uff0c\u5c31\u50f1\u50ad\u689d\u6b3e\u8a02\u7acb\u7684\u5354\u8b70\uff0c\u66f8\u9762\u6216\u53e3\u982d\u8b1b\u7684\uff0c\u4e5f\u7b97\u662f\u50f1\u50ad\u5408\u7d04\u3002\u53ea\u8981\u4e0d\u9055\u53cd\u300a\u50f1\u50ad\u689d\u4f8b\u300b\u53ca\u5176\u4ed6\u6cd5\u4f8b\uff0c\u50f1\u50ad\u96d9\u65b9\u53ef\u4ee5\u96a8\u610f\u5546\u8a0e\u548c\u78ba\u8a8d\u50f1\u50ad\u689d\u6b3e\u7684\u5167\u5bb9\uff0c\u597d\u50cf\u662f\u5de5\u8cc7\u6709\u591a\u5c11\u3001\u600e\u6a23\u8a08\u7b97\u3001\u6709\u6c92\u6709\u52a0\u73ed\u8cbb\u548c\u6d25\u8cbc\u3001\u6709\u6c92\u6709\u96d9\u7ce7\u548c\u82b1\u7d05\u3001\u8fad\u8077\u8981\u591a\u4e45\u4e4b\u524d\u901a\u77e5\u7b49\u7b49\u3002\u52de\u5de5\u8655\u7de8\u88fd\u4e86\u4e00\u4efd\u50f1\u50ad\u5408\u7d04\u6a23\u672c\u4f9b\u5e02\u6c11\u53c3\u8003\uff0c\u5927\u5bb6\u53ef\u4ee5\u5728\u52de\u5de5\u8655\u7684\u7db2\u7ad9\u4e0b\u8f09\u3002\u300a\u50f1\u50ad\u689d\u4f8b\u300b\u898f\u5b9a\uff0c\u50f1\u4e3b\u5fc5\u9808\u8981\u5728\u8058\u8acb\u4e4b\u524d\uff0c\u6e05\u695a\u901a\u77e5\u54e1\u5de5\u4ed6\u5011\u7684\u50f1\u7528\u689d\u4ef6\u7d30\u5247\u662f\u751a\u9ebc\uff0c\u5426\u5247\u50f1\u4e3b\u53ef\u4ee5\u88ab\u6aa2\u63a7\u3002<\/p>\n<p>\u9664\u4e86\u50f1\u50ad\u5408\u7d04\uff0c\u8001\u95c6\u9084\u53ef\u4ee5\u4ee5\u81ea\u50f1\u65b9\u5f0f\uff0c\u8ddf\u54e1\u5de5\u8a02\u7acb\u670d\u52d9\u5408\u7d04\u3002\u70ba\u907f\u514d\u5c07\u4f86\u53ef\u80fd\u6709\u62d7\u64ac\uff0c\u8001\u95c6\u5728\u8a02\u7acb\u5408\u7d04\u6642\uff0c\u6700\u597d\u8ddf\u5c0d\u65b9\u641e\u6e05\u695a\u8eab\u4efd\uff0c\u7a76\u7adf\u662f\u50f1\u54e1\u9084\u662f\u627f\u5305\u5546\uff0c\u4ea6\u5373\u81ea\u50f1\u4eba\u58eb\u3002<\/p>\n<p>\u81f3\u65bc\u600e\u6a23\u5206\u8fa8\u50f1\u50ad\u95dc\u4fc2\u8207\u627f\u5305\u95dc\u4fc2\u5462\uff1f\u5176\u5be6\u4e26\u6c92\u6709\u4e00\u500b\u55ae\u4e00\u800c\u6982\u62ec\u7684\u6e2c\u8a66\u7684\uff0c\u4f46\u53ef\u4ee5\u8003\u616e\u4e00\u4e9b\u56e0\u7d20\uff0c\u597d\u50cf\u662f\u62db\u8058\u548c\u8fad\u9000\u7531\u8ab0\u6c7a\u5b9a\u3001\u8ab0\u652f\u4ed8\u5de5\u8cc7\u3001\u8b00\u751f\u5de5\u5177\u548c\u6750\u6599\u7531\u8ab0\u63d0\u4f9b\u3001\u54e1\u5de5\u662f\u5426\u53ef\u4ee5\u5206\u4eab\u76c8\u5229\uff0c\u9084\u662f\u8981\u627f\u64d4\u8667\u8755\u7684\u98a8\u96aa\u7b49\u3002\u52de\u5de5\u8655\u548c\u7a05\u52d9\u5c40\u90fd\u6709\u53c3\u8003\u6e96\u5247\uff0c\u5e6b\u52a9\u5927\u5bb6\u8a55\u4f30\u4e00\u4efd\u670d\u52d9\u5408\u7d04\u662f\u5426\u50f1\u50ad\u5408\u7d04\uff0c\u5927\u5bb6\u53ef\u4ee5\u5230\u9019\u5169\u500b\u653f\u5e9c\u90e8\u9580\u7684\u7db2\u9801\u770b\u770b\u3002<\/p>\n<p>\u5e38\u5e38\u8aaa\u300c\u51fa\u7ce7\u3001\u51fa\u7ce7\u300d\uff0c\u4f46\u539f\u4f86\u5de5\u8cc7\u4e0d\u55ae\u53ea\u662f\u85aa\u91d1\u7684\uff0c\u9084\u53ef\u4ee5\u5305\u62ec\u5f88\u591a\u6771\u897f\uff0c\u597d\u50cf\u662f\u5c0f\u8cbb\u3001\u4ea4\u901a\u6d25\u8cbc\u3001\u52e4\u5de5\u6d25\u8cbc\u3001\u4f63\u91d1\u548c\u8d85\u6642\u5de5\u4f5c\u88dc\u8cbc\uff0c\u90fd\u662f\u5de5\u8cc7\u7684\u4e00\u90e8\u5206\u3002\u5e74\u7d42\u916c\u91d1\u3001\u9063\u6563\u8cbb\u3001\u9577\u671f\u670d\u52d9\u91d1\u3001\u75be\u75c5\u6d25\u8cbc\u3001\u5047\u671f\u85aa\u916c\u3001\u5e74\u5047\u85aa\u916c\u53ca\u4ee3\u901a\u77e5\u91d1\u7b49\uff0c\u4e5f\u662f\u4ee5\u5de5\u8cc7\u7684\u5b9a\u7fa9\u4f86\u8a08\u7b97\u3002\u300a\u50f1\u50ad\u689d\u4f8b\u300b\u6c92\u6709\u898f\u5b9a\u50f1\u4e3b\u4e00\u5b9a\u8981\u767c\u653e\u5e74\u7d42\u916c\u91d1\uff0c\u52de\u8cc7\u96d9\u65b9\u61c9\u8a72\u81ea\u884c\u9054\u6210\u5354\u8b70\uff0c\u4f46\u5982\u679c\u5408\u7d04\u8a02\u660e\u4e86\u662f\u6709\u5e74\u7d42\u916c\u91d1\uff0c\u800c\u50f1\u4e3b\u53c8\u6c92\u6709\u6839\u64da\u5408\u7d04\u5411\u5408\u8cc7\u683c\u7684\u50f1\u54e1\u767c\u653e\u5e74\u7d42\u916c\u91d1\u7684\u8a71\uff0c\u5c31\u662f\u72af\u6cd5\uff0c\u53ef\u4ee5\u88ab\u7f70\u6b3e\u3002<\/p>\n<p>\u75312011\u5e745\u67081\u65e5\u958b\u59cb\uff0c\u6240\u6709\u6253\u5de5\u4ed4\u90fd\u53d7\u5230\u6cd5\u5b9a\u6700\u4f4e\u5de5\u8cc7\u4fdd\u969c\uff0c\u8001\u95c6\u5982\u679c\u6c92\u6709\u7d66\u4e88\u6700\u4f4e\u5de5\u8cc7\uff0c\u5c31\u7b49\u540c\u6b20\u85aa\u3002\u6839\u64da\u300a\u50f1\u50ad\u689d\u4f8b\u300b\uff0c\u50f1\u4e3b\u5982\u679c\u6545\u610f\u53ca\u6c92\u6709\u5408\u7406\u8faf\u89e3\uff0c\u800c\u4e0d\u6e96\u6642\u767c\u5de5\u8cc7\u7d66\u54e1\u5de5\uff0c\u5c31\u662f\u72af\u6cd5\uff0c\u4e00\u7d93\u5b9a\u7f6a\u5 href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/608\" target=\"_blank\" rel=\"noopener\">Minimum Wage Ordinance (Cap. 608)<\/a> came into operation on 1 May 2011. Since then, the Statutory Minimum Wage (SMW) has become effective on the same day. With effect from 1 May 2023, the statutory minimum wage rate is revised to $40 per hour. In essence, wages payable to an employee in respect of any wage period, when averaged over the total number of hours worked in the wage period, should be no less than the SMW rate.<\/p>\n<p>Since the calculation of minimum wage excludes the time that is not hours worked, payment made to the employee for any time that is not hours worked (e.g. rest day pay, holiday pay, annual leave pay, maternity leave pay, sickness allowance, etc.) must not be counted as part of the wages payable to the employee.<\/p>\n<p>Failure to pay minimum wage amounts to a breach of the wage provisions. Under the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\" target=\"_blank\" rel=\"noopener\">Employment Ordinance<\/a>, an employer who wilfully and without reasonable excuse fails to pay wages to an employee when it becomes due is liable to prosecution and, upon conviction, to a fine of $350,000 and to imprisonment for three years.<\/p>\n<p>The Labour Department has set out some guidelines on SMW. Special arrangement is provided under the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/608\" target=\"_blank\" rel=\"noopener\">Minimum Wage Ordinance<\/a>\u00a0so that persons with disabilities have the right to choose to undergo a productivity assessment to determine whether they should be remunerated at not lower than the SMW level or at a rate commensurate with their productivity.
